Anti-discrimination

Ombudsman/Ombudswoman

In the Republic of Croatia, protection against discrimination based on race, ethnic origin or color of skin, sex, language, religion, political or other belief, national or social origin, proprietary status, trade union membership, education, social, marital or family status, age, health status, disability, genetic inheritance, gender identity, sexual expression or orientation is guaranteed by the Anti-discrimination Act.

Central body for protection against discrimination is the Ombudsman/Ombudswoman, authorized by the Croatian Parliament to promote and protect human rights and freedoms as defined by the Constitution, laws and international legal acts on human rights and freedoms adopted by the Republic of Croatia.

Ombudsman acts on the basis of a complaint only in the absence of court proceedings. Complaints should be filed on a form published on the Web-site of the Ombudsman/Ombudswoman or as a personal complaint submitted by hand, regular mail or electronically.

Ombudsman/Ombudswoman acts also based on anonymous complaints.

Ombudsman/Ombudswoman shall examine the complaint and undertake the actions belonging to his/her area of competence required for elimination of discrimination, and inform the applicant thereon.

Gender Equality Ombudsperson

In accordance with the Gender Equality Act, Gender Equality Ombudsperson is established as an independent and authonomous body for fight against discrimination in the area of gender equality. Gender Equality Ombudsperson monitors the implementation of the Gender Equality Act and other regulations relating to gender equality.

Citizens can turn to the Ombudsperson if they believe that they have experienced discrimination based on gender and marital or family status, as well as sexual orientation and gender identity. The Ombudsperson may be addressed in writing to the address, orally, by telephone, e-mail. The application is made via the online form on the Ombudsman’s website. Upon receipt of the application, the Ombudsperson will contact the applicant in the manner indicated for the appointment of the meeting. If it is an anonymous report, the procedure is followed by the report, but it is difficult to collect data and determine the situation. The Ombudsperson will act upon the application within 30 days.

Legal aid Clinic

Protection against discrimination is also possible through the Legal Clinic established at the Faculty of Law in Zagreb, i.e. through a section for combating discrimination and minority rights set up within the Legal Clinic.

Authorized applicants for legal aid can contact the Legal Clinic in person, by mail to the address of the Legal Clinic or by fax. To ensure monitoring of the quality of legal aid provided, the Legal Clinic does not provide flat-rate advice by phone or e-mail. The request for legal assistance is submitted via the online form on the clinic’s website. The case is assigned to a certain group upon receipt and on average they bring the final text of the legal opinion within 10 days and it is delivered to the indicated address or delivered by prior arrangement. Upon receipt and acquaintance with the case, the Legal Clinic will inform the applicant about the expected duration of the procedure.

University enrollment

Higher education in the Republic of Croatia is conducted through universities and professional studies.

University studies prepare students to perform jobs in science and higher education, in the business world, the public sector and society in general, and enable them to develop and apply scientific and professional achievements. Professional study provides students with an appropriate level of knowledge and skills that enable them to perform professional occupations and enables them to be directly involved in the work process.
University studies include three levels: undergraduate, graduate and postgraduate study.

Since the accession of the Republic of Croatia to the European Union, full-time students who are citizens of the Member States of the European Union (EU students) have the same rights to access education as students who are citizens of the Republic of Croatia.

Among other things, the right to access education implies the right to pay the same amount of tuition fees as students who are citizens of the Republic of Croatia. Consequently, if students who are citizens of the Republic of Croatia are entitled to a tuition subsidy, the same right is exercised by EU students.

Full-time EU students are also entitled to subsidized meals, as are students who are citizens of the Republic of Croatia.

In the Republic of Croatia, it is prescribed that certain levels of study programmes should have a certain number of ECTS credits, as follows:

  • Undergraduate level from 180 to 240 ECTS credits

Graduate level from 60 to 120 ECTS credits.

It is important to keep in mind that the total number at the undergraduate and graduate level must be at least 300 ECTS credits. Students can transfer their ECTS credits from one university to another.

The ranking list for enrollment in the study is compiled according to the points acquired by the registered applicants. Points can be earned in the following four categories: a) based on grades acquired in secondary school b) based on passed exams of the state “matura” exam c) based on additional assessments of specific knowledge, skills and abilities d) based on additional student achievements

Each faculty determines the documents required for enrollment. This is a list of the most frequently required documents

  1. registry form and enrollment form, available for download on the web page
  2. consent form, available for download from the faculty web page
  3. payment confirmation for enrollment costs cca 150.00 – 500.00 kuna (cca 20 – 60 EUR)
  4. one photo, 4×6 cm
  5. certificate of residence or copy of identity card
  6. students from the eu or outside the republic of Croatia and eu (foreign students) – copy of passport
  7. registration number (the applicant receives it in the nispvu system when confirming the intention to enroll in higher education institution) – for inspection.
  8. scanned handwritten signature

Each faculty determines the cost of the entrance exam and the cost of enrollment – 150.00 – 500.00 kuna (approx. 20 – 60 euro). Any forms are in the competence of each faculty.

Undergraduate study lasts three to four years; graduate study lasts from one to two years, with the total duration of undergraduate and graduate level being at least five years. The third level of study refers to postgraduate or doctoral studies.

Participation in study costs for students who are not entitled to a full subsidy (according to the Agreement) as well as for part-time and foreign students is determined by the faculty/academic councils of the constituents, and the maximum amount of participation is defined by the Senate’s Decision. Students from Member States of the European Union are equal in academic rights and obligations with students from the Republic of Croatia.

Schooling

The education system of the Republic of Croatia comprises the following

  • Early and preschool upbringing and education– includes education, training and care for preschool children, and it is realized within programs for education, training, health care, nutrition and social care for children from six months until starting school.
  • Primary education – lasts 8 years and is compulsory for all children, usually from the age of six to fifteen. All children in Croatia who turn six by 1 April of the current year are covered by the obligation to enroll in primary school in the same year.
  • Secondary education – in Croatia includes:
    • gymnasiums – general secondary schools that last four years (include education tracks in science, mathematics, science and mathematics, language, general, and classical education);
    • vocational schools, which are divided into technical schools in different vocational areas and other vocational schools in various areas ( industry, economy, medicine ), that last four years;
    • art schools that focus on dance, music and fine arts, which also last four years;
    • industry and related economy and craft schools that last for a period of three years and prepare students for specific occupations in these areas.
  • Higher education – lasts three years (six semesters) for a bachelor’s degree (undergraduate study) and five years (ten semesters) for a master’s degree or six years (twelve semesters) for a professional doctorate (graduate study). The postgraduate, doctoral study lasts three years (six semesters). A bachelor’s degree can also be awarded at polytechnics and colleges. In addition to university studies, there are also various professional and specialist studies.

The Ministry of Science and Education is responsible for the entire education system in the Republic of Croatia.

Local and regional self-government units are the legal founders of pre-school education institutions, primary and secondary schools, and as founders they are responsible for educational processes in their area.

Enrollment of students in high school is based on the Rules of Procedure on the Elements and Criteria for Enrollment in Secondary Schools 2020/2021. The student enrollment competition shall be published no later than June 30, 2020 on the web pages and bulletin boards of secondary schools and founders. Students who do not complete primary education as regular primary school students in the Republic of Croatia, who complete primary education or have completed it abroad or in other educational systems, apply to the Central Application Office in the manner described on the web page www.upisi.hr

Applications and enrollment in secondary schools begins 1 June and ends 27 July of the current year.

Language courses

Learning a foreign language is a demanding task that requires time and effort. It is important to practice the language as much as possible, devote yourself to learning it as much as you can and practice without fear of making mistakes.

The main goal of the Learning Programme on Croatian language, history and culture for foreigners is to enable foreign students to master the Croatian language according to the levels of the Common European Framework of Reference and to become familiar with Croatian history and culture.

Participants can enroll in one of the following levels:

  • Level  A1 ‒ intended for students who do not know the Croatian language and Latin alphabet, do not know the standard of the Croatian language or the grammatical structure
  • Level A2 ‒ intended for students who can understand and use familiar everyday expressions and very simple phrases related to meeting specific needs; they can introduce themselves and others and ask and answer questions about themselves and others; they can have a simple conversation provided that the interlocutor speaks slowly and clearly and is ready to help during the conversation
  • Level B1 ‒ intended for students who can understand isolated sentences and frequently used words from the area of immediate personal interest; they can communicate in simple and common situations that require a simple and direct exchange of information on familiar topics and activities
  • Level B1+ ‒ can easily describe aspects of their education, their immediate environment and content from the area of meeting immediate needs
  • Level B2 ‒ participants can understand the main thoughts of a clear, standard conversation on familiar topics that they regularly encounter at work, school, leisure, etc.; they can handle most situations they encounter when traveling through Croatian-speaking areas; can write a simple text on a familiar topic or topic of personal interest, describe experiences and events, hopes and aspirations, and can briefly illustrate and explain their views and plans
  • Level (C1) ‒ Advanced ‒ Participants can understand the main ideas of a complex text about a concrete or abstract topic including technical discussions in their field of expertise; can communicate fluently and effortlessly enough to engage in a normal interaction with a native speaker effortlessly from either side; can write a clear, detailed text on a large number of topics and explain their views on a current topic, listing the advantages and disadvantages of various options

Classes are conducted through lectures and through a group and individual manner of learning, 2-3 times a week (depending on arrangement, staff and space availability) for 4 school periods (180 minutes). Upon completion of a certain level of the programme, participants receive a certificate of completion of the Learning Programme on Croatian language, history and culture for foreigners.

The Learning Program  Croatian language, history and culture for foreigners is available to all foreign persons with a regulated legal status in the Republic of Croatia, i.e. foreigners with a granted temporary residence in the Republic of Croatia.

The certificate is issued upon completion of a certain level, it is rectangular in A4 format, printed on the prescribed paper and in Croatian, it contains the name and family name of the student along with the description of the program and students obligations and the number of acquired ECTS credits.

Recognition of academic and professional qualifications

The right to the recognition of foreign educational qualifications belongs to Croatian citizens, foreign citizens and stateless persons.

Depending on the type of qualification whose recognition is required, the competence for conducting the procedure of foreign educational qualification recognition belongs to:

    1. The procedure of recognition of completion of foreign primary education for employment purposes and secondary school (general-orientation, gymnasium and artistic programs) for the purpose of employment or further education is conducted by the Education and Teacher Training Agency.
    2. The procedure of recognition of completion of foreign secondary education under vocational scheme for the purposes of employment or further education is conducted by the Agency for Vocational Education and Training and Adult Education.
    3. The procedure of recognition of primary or secondary education for the purpose of further primary or secondary education is conducted by the school in which the applicant intends to continue schooling.
    4. The procedure of recognition of primary education for the purpose of starting secondary education us conducted by the school in which the applicant intends to continue schooling.
    5. Recognition of higher education qualifications and study periods for the purpose of further education in the Republic of Croatia is under the competence of universities, polytechnics and colleges, while the recognition for the purpose of employment is under the competence of the Agency for Science and Higher Education , National ENIC / NARIC Office.

 

For the recognition of primary school completion for the purpose of employment in the Republic of Croatia:

      1. original or certified copy of the most recent certificate (school report, diploma) acquired abroad;
      2. sworn translation into Croatian of the certificate, issued by court interpreter/translator, except for the documents issued in Croatian and in Latin script;
      3. certificate of citizenship (copy of the “domovnica”, identity card, passport or any other public document proving citizenship);
      4. acknowledgment of the payment of administrative fee in the amount of 140 kuna ( approximately 19 euro) into the account of the State budget or certificate proving general exemption from administrative fee payment, issued by the local Tax Administration office of the place of the applicant’s ( temporary) residence or a proof of refugee, exile or other status, in accordance with Article 8 of the Administrative Fees and Taxes Act
      5. in case of change of name or family name, a copy of the public document proving that change (for example, decision, vital records certificate).

 

For the recognition of secondary school completion for the purpose of employment or further education in the Republic of Croatia:

      1. original final certificate (diploma) obtained abroad (or a certified copy)
      2. sworn translation into Croatian of the final certificate, issued by court interpreter/translator, except for the documents issued in Croatian and in Latin script
      3. copies of secondary school certificates for each grade
      4. certificate of citizenship (copy of the “domovnica”, identity card, passport or any other public document proving citizenship);

Deadlines for issuing a decision:

      1. no later than 30 days, counting from the day of submission of a correct request (a correct request is one that contains all the necessary documentation for its resolution)
      2. 60 days, counting from the day of submitting a correct request for cases where an examination procedure is conducted

 

If it is necessary to verify the authenticity of the foreign educational qualification whose recognition is requested, the deadline for issuing the decision shall cease to run and shall continue the day of receipt of the statement from competent authorities.

Education

The education system of the Republic of Croatia comprises the following:

Early and preschool upbringing and education

for children from six months until the beginning of primary school. School year generally starts on 1 October of current year and lasts until 1 June of the following calendar year.

Primary education  

mandatory for all children, mostly from six to fifteen years of age; the obligation to attend primary school applies to all children whose temporary residence is in the Republic of Croatia, notwithstanding their citizenship. Primary school lasts eight years and offers regular and extraordinary programs. Children over 15 who have not completed primary school can enroll in the primary education system for adults.

Secondary education

Upon completion of primary education, students have the opportunity to continue their education in secondary education institutions whose attendance is not mandatory; gymnasiums, vocational schools and art schools. All students are entitled to attend the first class of secondary schools under the same conditions, however depending on the total number of posts foreseen by the yearly decision of the Minister competent for education. Candidates’ applications and enrolment on the first classes of secondary schools are conducted through the National Information System of Secondary School Application and Enrolment. Secondary education starts with secondary school enrolment, while the knowledge and skills acquired during secondary school prepare for either work or further education. Tailor-made procedures are foreseen for the education of disabled students in regular or special classes and educational groups, whereas students with more serious disabilities attend special institutions. Gymnasiums prepare students for further education, vocational schools train them for entering the labor market, offering them at the same time the opportunity to continue their further education, and finally art schools provide with knowledge, develop skills, capacities and creativity in various areas of art. After secondary school, students can take the School leaving exam (matura) at A (higher) or B (lower) level. School leaving exams can be taken by other candidates who completed secondary education abroad which is comparable to the four-year secondary education in Croatia. Higher education

is provided by universities, faculties or academies of art, polytechnics and colleges. Students from EU Member States can enroll their study programms under the same conditions as Croatian citizens.

School year (primary and secondary education) starts on 1 September and lasts until 31 August. In the course of the school year pupils are entitled to winter, spring and summer breaks.

The academic year starts on 1 October of the current year and ends on 30 September of the following calendar year.

Accidents insurance

Accidents at work and occupational diseases

If you are a national of a European Union country and suffer an accident at work or fall ill with an occupational disease while in Croatia, you are entitled to healthcare with a European Health Insurance Card.

The above-mentioned refers to:

  • benefits in kind and cash benefits in case of an accident at work or an occupational disease;
  • pension insurance system benefits.

 

Accidents at work and occupational diseases in Croatia are covered by mandatory health and mandatory pension insurance.

  • Benefits are paid from mandatory health insurance in case of temporary incapacity for work,
  • Benefits in case of disability and physical impairment are paid from pension insurance.

 

Conditions:

In the case of an accident at work or an occupational disease, you are insured not only if you are employed or self-employed, or a farmer, but also if you are a member of a special group of insured persons for whom insurance is provided. These are, for example, pupils and students during practical training, vocational practice, study tours, and members of voluntary fire departments during fire-fighting activities. No prior insurance is required to be eligible for benefits in the case of an accident at work or an occupation disease.

This holds true for benefits when incapacitated for work, i.e. sickness, as well as when claiming invalidity pension, professional rehabilitation and survivor’s pension.

 

Claiming rights:

Under health insurance, you may claim the following due to an accident at work or an occupational illness:

  • screenings and diagnostic procedures as part of specific healthcare at a specialist doctor chosen by the employer. If you are self-employed, you choose your own doctor.
  • in the case of an accident at work and suspicion of an occupational disease, proceedings must be instituted at the competent local office of the Croatian Health Insurance Fund (HZZO) by submitting the accident at work/occupational disease notification. This is done by your employer and your chosen primary health care doctor.
  • sick leave is dealt with by your chosen primary healthcare doctor.
  • you claim travel costs by submitting an application to the competent local office of the HZZO.
  • funeral costs are claimed by submitting an application to the competent local office of the HZZO and are paid to the person who covered costs of the funeral (for example, a family member).

Within the pension insurance system, you may be entitled to invalidity pension, occupational rehabilitation and impairment benefit.

  • Entitlement to disability pension and professional insurance proceedings are initiated at the request of your chosen doctor if you are insured (see chapter Invalidity pension);
  • The process of claiming body impairment benefit begins by filing an application with the regional office of the Croatian Pension Insurance Institute (HZMO) in your place of residence.
  • On the basis of your application, a medical assessment will be carried out by the Institute for Medical Assessment, Occupational Rehabilitation and Employment of People with Disabilities.

Sickness/health insurance and disability

If you are a citizen of an EU Member State and you suddenly fall ill, get injured or get into an accident during your stay in Croatia, you are entitled to health protection based on the European Health Insurance Card.

The above-mentioned refers to:

  • mandatory medical insurance;
  • supplementary medical insurance.

Conditions:

Every person who has a residence in the Republic of Croatia and foreign persons with a registered permanent stay are registered for the mandatory medical insurance of the Croatian Institute for Health Insurance (HZZO), if not otherwise stipulated in an international agreement.

  • Nationals from other countries in the EU are obligated to register for insurance, provided that they are not insured in the other country, along with non-EU nationals, if they are granted temporary residence in Croatia.
  • They are insured based on their employment contract with an employer that has its headquarters in Croatia or based on them performing an economic or professional activity in Croatia, if EU regulations, i.e. international agreements do not state differently.

You can register for supplementary medical insurance only if you are registered as an insured person with mandatory health insurance with the HZZO.

Mandatory medical insurance with the HZZO is granted based on various conditions (e.g. employment contract, performing economic activity, retirement, family member of an insurance holder). You are granted the right to health protection within mandatory health insurance if you are a registered insured person with the HZZO.

Your status of person insured with the Croatian Institute for Health Insurance is confirmed with a health insurance card, i.e. a certified copy of the application for health insurance. If you are a mandatory health insurance insuree and you are older than 18, you can register for supplementary medical insurance.

The rights included in the mandatory health insurance are granted when you register with the regional HZZO office for your place of permanent or temporary residence.

You should usually register within 30 days.

 

The insurance includes:

  • the right to primary health protection;
  • the right to specialist-conciliar health protection;
  • the right to hospital health protection;
  • the right to use medicinal products defined in the basic and supplementary list of medical product of the HZZO;
  • right to help regarding dental prosthetics and to dental prostheses;
  • right to orthopedic and other aids and right to health protection abroad

Parent caregiver status or caregiver status

  • Parent caregiver status can be acquired by parents of a child with developmental disabilities or a disabled adult.
  •  If the family has two or more children with developmental disabilities or disabled persons, the status of parent caregiver can be acquired by both parents.
  • Exceptionally, when the parents of a child with developmental disabilities die or neither parent lives with the child or cares for the child, the status of caregiver can be transferred to one family member who lives with the child. This right can be claimed even if the parent cannot care for the child due to their psychological or physical state.
  • A family member can have this status even if in a single-parent family there are two or more children with developmental disabilities or there is a disabled adult.
  • The right to the parent caregiver status, instead of a parent, can also be acquired by a  married or cohabitating partner of the parent of the child with developmental disabilities or disabled adult if they live in a family unit.

Conditions:

  • Parent caregiver or caregiver status can be claimed if a child or disabled adult is entirely dependent on the assistance and care of another person, i.e. if they are completely immobile and use orthopedic aids.
  • Status can also be acquired if the child or disabled person has several types of severe impairments (physical, mental, intellectual or sensory), because of which they completely depend on the assistance and care of another person to meet their basic living needs.
  • Parent caregiver or caregiver status cannot be acquired if a child with developmental disabilities or disabled adult received residential care, organized living, or full-day or half-day semi-residential care.
  •  Parent caregiver or caregiver status cannot be acquired when a child with disabilities or disabled adult stays 4 or more hours a day in a pre-school, educational or healthcare institution, social care home or at some other accommodation service provider.
  • A parent caregiver or a caregiver shall be entitled to an allowance, as well as to pension insurance, health insurance and unemployment rights at the expense of the State Budget.
  • A parent caregiver or caregiver may also be entitled to child benefit.
  • A parent caregiver or caregiver is entitled to mandatory pension insurance. Parent caregiver or caregiver status is obtained via the Social Welfare Centre in the place of residence of the applicant.

Family allowances

Child benefit

  • If you have been permanently residing in Croatia for at least 3 years, or have had the status of a foreigner with an approved permanent residence permit for at least 3 years, or asylum grantee status or a person under subsidiary protection without conditions in terms of citizenship or length of residence, and your household income is below a certain threshold, you are entitled to child benefit.
  • You can claim child benefit if your total income, earned in the previous calendar year, does not exceed 70% of the calculation base.
  • In other words, if the average income per member of your household does not exceed HRK 2,328.20 (EUR 221.00) a month.
  • If you claim child benefit for three or more children, you are also entitled to birth grant, but on condition that your income is not greater than the income threshold.
  • Child benefit can be claimed by a parent, adoptive parent, caregiver, stepfather, stepmother, grandmother, grandfather and foster parent.
  • The claimant may be a grown child without both parents who is in full-time education.
  • Child benefit, as a rule, is paid for children aged up to 15 years or 19 years old. It may be prolonged to 21 years for a child who did not finish school in the usual period of time due to illness.
  • For severely disabled children up to the age of 18 or while a full time student, child benefit is paid while such disability exists.

Parental entitlements

time and cash benefits available to beneficiaries:

  • Maternity and parental leave;
  • Right to work half your working hours in order to provide your child with more care;
  • Leave for caring for a child with severe development disabilities;
  • Adoptive parent leave;
  • cash assistance (income-replacement benefit, lower cash benefit, cash assistance).

Foreign nationals with permanent residence in Croatia, asylum grantees and persons under subsidiary protection have the same rights as Croatian nationals.

Conditions:

  • If you are an employed or self-employed parent, in order to claim income-replacement benefit while on maternity or parental leave, you must have at least 12 months pensionable service (see Jargon busters) or at least 18 months in the last 2 years if you had interruptions in your career.
  • If you fail to meet this condition, you are entitled to a reduced amount of income-replacement benefit.
  • If you are a parent with other income or a farmer outside of the value added tax or income tax system, you must have been permanently residing in Croatia for at least 3 years, or have had a permanent residence permit for at least 3 years if you are a foreign national.
  • If you are a parent outside of the labour system, you must have Croatian citizenship and have permanently resided in Croatia for at least 5 years.
  • Foreign nationals must have had a permanent residence permit for at least 5 years.
  • All categories of parent must be insured under the mandatory health insurance scheme.
