Unemployment allowances

The unemployment benefit is a cash value that is paid each month to those who lost their jobs involuntarily, and who are registered for employment at the Employment Center or Employment Service of the Employment and Vocational Training Centers. The unemployment benefit is intended to compensate for the loss of wages of work. If you do not meet the conditions for receiving the Unemployment Benefit, you may be entitled to the Initial Unemployment Social Allowance. If you have already received all the Unemployment Benefit to which you were entitled and remain unemployed, you may be entitled to the Subsequent Unemployment Social Allowance.

To apply for the allowance, you must be registered in the Employment Service (IEFP). The allocation and management of unemployment benefits is responsibility of the Social Security Institute.

Conditions:

  • Live in national territory
  • Be in a situation of involuntary unemployment
  • Have the capacity and availability to work
  • Be registered for a job search at the job center in your area of residence
  • Have the required warranty period: 360 working days for others with a record of remuneration in the 24 months prior to the date of unemployment.
  • In the case of agricultural and domestic service workers, periods of registration of remuneration are considered by equivalence to the entry of contributions (in which you have been receiving sickness benefits or parenting from the social security system) up to a maximum of 120 days.

The warranty period includes the days you worked:

  • In a European Union member, in Iceland, Norway, Liechtenstein or Switzerland
  • In countries with which Portugal has signed Social Security Agreements, which allow periods of contributions registered in those countries to be counted in Portugal for access to unemployment benefits.
  • If necessary, can be considered periods for recording remuneration for exercising an independent professional activity.

Unemployment benefit has to be claimed within 90 consecutive days from the date of unemployment, at the job center
Documents to be provided,

Identity card or passport valid for citizens of the European Union and Taxpayer Card.

Duration:

It depends on the age of the beneficiary and the number of months with a record of Social Security payments since the last unemployment situation.

Appeal procedures:

  • directly by the employer through Social Security Direct (only with the employee’s authorization, the employer must deliver a copy to the worker)
  • on paper by the worker in the Employment Service. If the employer refuses or is unable to submit a declaration of unemployment, namely due to the employer’s death, it will be the Authority for Working Conditions (ATC) who will pass it on, within 30 days from the date the worker asks for it

  • Declaration by the employer that proves unemployment and indicates the date of the last remuneration (Model RP5044 / 2013-DGSS).

Old age and survivor pensions

Provide a general explanation about old age and survivor pensions (min 300 max 400 words)

Foreign citizens over 66 years of age, who have worked and paid for Portuguese Social Security for more than 15 years, are entitled to an old-age pension.

To request the Old-Age Pension you can go to:

  • To the Social Security Direct website.
  • In Social Security services, including the National Pension Center.
  • If you live abroad, the pension application is submitted to the Social Security institution in the country of residence, if there is an international Social Security agreement with Portugal, or to the National Pension Center, if not: Send by mail (If you send the form by this means, you must also send an addressed and sealed envelope to Social Security to return the receipt proving the delivery of the order)

If you are a non-resident, it is possible that your income will be taxed twice, since you are living as a pensioner in one country and receiving a pension from another country.

In these situations, you will always be subject to the tax regime of your country of residence, but you may also have to pay taxes in the other country.

Social Security is a system that aims to ensure basic citizens’ rights and equal opportunities. It is assumed that natural and legal persons who relate to Social Security are subject to identification in the information system, through the attribution of a Social Security Identification Number (NISS).

“NISS na Hora”, is an update of Social Security, aimed at foreign citizens who intend to start their professional activity under the Employee, Independent Worker or Domestic Service Worker regimes. To issue the NISS, you must go to any Social Security facility (at the District Headquarters of each District Center, with a specific service center, and at the Local Service Center).

In Portugal, the tax regime is a set of rules and institutions that govern the tax situation of an individual or legal entity. It is, therefore, the set of rights and obligations arising from the development of a particular economic activity.As soon as you start your professional activity in Portugal you should pay attention to the taxes that fall on your income and double taxation.If you live in Portugal you will have to pay the Personal Income Tax (IRS) – a tax that is rated on the income of taxpayers. It focuses on income that is directly attributed to citizens, whether they are residents in Portugal or the so-called non-residents who earn income in the national territory.The amount associated with this tax will be calculated based on the income of each person, and the employee/person must deliver an annual income statement (previously submitted by the employer), through the Finance Portal or in person.Regarding double taxation at the professional level, this happens from the moment you work in one country, but you are a resident of another, that is, if both countries are entitled to tax your income you may be subject to both tax regimes.

Tax regime for non-habitual residents: aimed at non-resident professionals qualified in activities with high added value or intellectual or industrial property , or know-how, as well as beneficiaries of pensions obtained abroad. For this purpose you will have to:

  • Register as a resident in Portugal (through the “Portal das Finanças” or “Loja do Cidadão”);• Application for registration as a non-habitual resident (through the “Portal das Finanças” or paper application)• Have professional or academic experience of the identified added value activities• To apply for double taxation exemption, you may need to prove your country of residence and that you have already paid taxes on your income. Inquire with the tax authority about the documents and evidence you must present.

In addition to the mentioned tax obligations, it is important to be aware of other taxes you may have:. Corporate Income Tax (IRC): levies on the income of companies operating in Portugal.

  • Value added tax (VAT): on consumption that applies to almost all goods and services purchased and sold for use or consumption in the EU.
  • Municipal Property Tax (IMI): it is a fee that is charged every year to property owners.

You must request a Tax Identification Number (NIF) from a Finance Service or Loja do Cidadão, which will identify you before the Tax and Customs Administration (AT).

Traineeship and apprenticeship

There are flexible educational paths suitable for different situations and personal profiles, in the following areas:

  • Recognition, Validation and Certification of Skills (RVCC) – allows to recognize, validate and certify the knowledge and skills resulting from the learnings carried out by adults throughout their lives, in formal, non-formal and informal contexts.
  • Adult Education and Training (EFA) is an education and training offering for adults who want to raise their qualifications. These courses are developed along double certification paths.
  •  Technological Specialization – these are non-higher post-secondary training courses that prepare for a scientific or technological specialization in a specific training area, aim to provide a level 4 professional qualification, with the approximate duration of one year (between 1200 hours and 1560 hours) .
  • Modular Training – Continuous training of active workers, gives adults the possibility to acquire more skills in order to obtain more school qualifications and professional qualifications, with a view to (re) insertion or progression in the labor market.
  • Secondary Education Level Completion Paths– these are responses created for those who attended, without completing, secondary education level training courses
  • Professional internship (IEFP): development of practical experience in the workplace, which cannot consist of occupying a job.

The recognition of Foreign Qualifications can be done through academic recognition or through professional recognition. Academic recognition is a process by which a foreign academic qualification is compared to a Portuguese qualification in terms of level, duration and program content. Professional recognition is the authorization by a competent authority (Ministry, Order, etc.) to exercise a specific regulated profession or professional activity.

The research career in Portugal is linked to the application for research grants. These grants are used to conclude the contract between the scholarship holder(researcher) and the entity that welcomes him, who in turn finances the research. To open your own business, it is crucial, these days, to develop creative and innovative ideas that meet the needs of customers.

According to the European Commission, as European citizens we are entitled to start their own company in any EU country. To facilitate this process, it is recommended to go to the National One-Stop Shop (existing in all EU countries (https://ec.europa.eu/growth/single-market/services/services-directive/in-practice/contact_en) which are managed by the EUGO network. Through this portal you can:

  • Explore new business opportunities or expand the services to another EU country;
    • Create a company;
  • Enquire about the necessary rules, legislation and information;
  • Carry out the necessary administrative procedures;
  • Enquire Information about licenses, notifications or authorizations necessary to create a company;
  • Requirements to provide services on a temporary basis;

 Types of Companies:

If the investment in Portugal is made through integration in a Portuguese company, the first step to be taken is the decision on the type of company to be created

The most used structures are the following:

• Public Limited company (S.A):  Company in which the share capital is divided into shares to be traded freely. It consists of a for-profit company and works as a capital company divided into shares, with the difference that, it provides profits that are distributed by the shareholders. The partners of these companies, therefore the shareholders, have limited responsability to the price of the acquired shares. To form this partnership it is necessary to have at least five partners.

  • Private Limited Company: company held by a single person (natural or legal), who owns all of its capital, and is subject to the rules applicable to private limited companies. In terms of liability, this format determines that the person holding the company’s share capital responds in a limited way to the respective amount (freely fixed by the company) for the debts incurred in the exercise of its activity before its creditors.
  • Limited Company: limited liability corporate form, consisting of two or more partners, whose share capital of the company is divided by shares. A limited company can also be sole proprietorship, when it is constituted by only one partner, holding all the share capital. The main difference between a Private Limited Company and a limited company lies precisely in the number of partners. In practical terms, the first consists of an individual company model and the second a collective model.

Documents to be provided:

Individual:
Taxpayer Card; Identification document – Citizen Card, Identity Card, Passport, Driving License or Residence Permit.
Note: The Driving License and Residence Permit are only accepted when the entity’s capital does not exceed € 15,000.00.
Legal person:

  • Company Card or access code; or Corporate Person Card or the access code;
  • Updated Commercial Registration Certificate;
  • Minutes of the General Assembly that grants powers for the constitution of the company.

Registration fees:

The cost of starting a business will depend on the legal form and the number of partners who will be part of the company, but also on the movable and immovable property associated with it. The main costs of starting a business are:

  • Cost of registration through the “Empresa na Hora”: 360 euros;
  • Certificate of Admissibility for the creation of the company: 70 euros, normal order or 150 euros for urgent orders;
  • In companies with real estate entries or shareholdings that have to be registered: 50 euros per property or quota;
  • Companies with movable goods: 30 euros for each asset;
  • If its associated: mopeds, motorcycles, tricycles or quads with cylinder sizes up to 50 cm3 with a limit of 30 thousand euros: 20 euros per vehicle.

Subordinate work

An employment contract is one by which a natural person undertakes, upon a retribution, to render his activity to another or other persons within the organization and under their authority. It is a document containing the following information: rights and duties of the employer and employee, place of work, opening hours, right to vacation, salary, allowances and bonuses (if applicable).
In Portugal, there are different employment contracts and in turn with different conditions and specificities.

The employment contracts provided are:

  • Fixed-term employment contract: it has a duration previously defined by the company and must be used only to satisfy the entity’s temporary needs. It has a maximum duration of 2 renewals
  • Open-ended contract:  if the employer made you this contract, it is because it is effective, that is, you belong to the company’s staff. It has no associated duration..
  • Uncertain term: contract: aims to satisfy the temporary needs of the company, but without an end date. It has a maximum duration of 4 years.
  • Very short-term employment contract: used for more specific purposes, such as seasonal agricultural activity or tourist events. The employment contract cannot exceed 35 days.
  • Temporary Work Contract; is done by a temporary company and the employer, and not with the company where you may perform functions / provide services. This contract follows the same logic as the fixed-term or uncertain contract, that is, its duration depends on the needs of the company.
  • Part-time employment contract: work that corresponds to a weekly period shorter than that practiced on a full-time basis,
  • Service agreement Contrat: this contrat provides that the service provider is an independent worker who has the autonomy to manage his work, time, space and contributions according to the needs of the company (ies). They are usually supplies of services or goods that happen pontually and without the need to contract signature as described above.

Family

European citizens can live in Portugal for up to 3 months, with a stay of more than 3 months and permanently. These measures apply equally if the respective family wants to move to Portugal, that are considered for this purpose: the spouse/partner, descendants up to 21 years old, descendants over 21 years old who prove to be dependent and ascendants dependent on the right holder.

Stays longer than 3 months are subject to the request for the Certificate of Registration for partners/spouse or dependents, they and other relatives are automatically accepted if they are seriously ill or depend on rigth holder economically. If this is not the case, the continuity process will be assessed under Portuguese law, but you will always have the following rights:

  • The application for a residence permit will be evaluated by the authorities of the host country;
  • You will receive a written response as soon as possible
  • If it is refused, you can appeal the decision.
  • If you are a student or pensioner, you must prove that you do not have economic difficulties and have complete medical coverage in the host country

If you intend to stay permanently in Portugal, is implicit the condition that you have already lived legally for 5 years in Portugal, and must apply for the Permanent Residence Certificate.

To request family reunification, you must submit an application to the SEF directorate or regional delegation in your area of residence, accompanied by the necessary documents.

Whenever the family members are outside the national territory, it is up to the holder of the right to family reunification (holder of a valid residence permit in Portugal) to make the request. The request to entrer and of residence for members of his family should be done to SEF.

However, whenever family members are already  on national territory, family reunification can be requested by them or by the right holder
Provide info about:

  • documents to be provided,
  • Valid identity card / passport;
  • Document proving the family relationship or the quality of a partner, if the relationship is not evident in the identity card / passport;
  • EU / EEA / Switzerland citizen registration certificate of the person that they accompany or are going to meet with;

Direct descendant over 21 years:

Document proving that you are at charge of the citizens of the EU / EEA / Switzerland that you are accompanying or meeting.

Other family members

Document issued by the competent authority of the country of origin or provenance, certifying that they are in charge of the EU citizen or that they live with them in housing or OR Proof of the existence of serious health reasons that imperatively require personal assistance by the citizen of the EU.

Certificate of Registration:

  • Valid national identity document or passport
  • Your registration certificate or other proof that you reside in the country
  • Proof of family bond (eg birth or marriage certificate)
  • In the case of children and grandchildren, proof that they are under 21 or at your (right holder) care
  • In the case of parents and grandparents, proof that they are at your(right holder) charge
  • In the case of other family members, proof that they are at your(right holder) charge or that they have serious health problems that require you to take care of them personally
  • In the case of a partner in non-marital partnership, evidence that attests to the existence of a lasting relationship with you (right holder)

Permanent Residence Certificate:

  • Valid Registration Certificate
  • Evidence that you have lived in the country (e.g., expense invoices and lease agreements)
  • Evidence that you are employed, are studying, are self-employed or job seekers (for example, salary forms, bank statements, tax returns).
  • registration fees: 15€
  • duration: Certificate of Registration: 5 years
  • appeal procedures: Go to the City Council of the area of residence (period of 30 days after 3 months of  entering in national territory)
